Terms and Conditions
The short version. These terms are a binding agreement. In plain words:
- LabCauldron is in beta, provided as is, with no guarantees. Keep your own copy of anything important.
- It is a teaching aid. Teachers and schools make every decision about marks, safety and academic integrity.
- You are responsible for what you upload and how you use LabCauldron, and you agree to cover our costs if your use leads to a claim against us (section 14).
- It is not affiliated with the International Baccalaureate Organization.
The full terms below are what count.
1. Agreement to these terms
These Terms and Conditions ("Terms") govern your access to and use of LabCauldron, including the website at labcauldron.com, any copy of it at another address, the prototype, and any related features or content (together, the "Service"). "LabCauldron", "we", "us" and "our" mean the developer of LabCauldron, Anum Kazi, and Webtronaut Innovations, LLC (webtronaut.com), a New Mexico limited liability company that built and hosts the prototype, together with the people and companies who host or operate the Service on their behalf. "You" means the person using the Service and, if you use it for a school or other organization, that organization too.
When you create a teacher account or join a class, you are asked to tick a box to agree to these Terms and to our Privacy Policy. By ticking it, or by otherwise accessing or using the Service, you agree to them. If you do not agree, do not use the Service.
2. Who may use the Service
- The Service is intended for teachers, school staff and students using it under the direction of their school.
- If you are under 18, you may use the Service only with permission from your parent or guardian, or as directed by your school.
- The Service is not directed at children under 13, and they may not use it.
- If you accept these Terms for a school or organization, you confirm that you have authority to bind it, and that it is responsible for the use of the Service by its staff and students.
- Teachers confirm that their school allows them to use the Service with their students, and that they will tell students (and, where the school requires it, parents or guardians) how it is used. A teacher is responsible for the classes they create, for sharing class codes only with their own students, and for the student accounts in those classes.
- Keep sign-in details secret. Do not share your password, PIN or an invite code. Tell us or your teacher straight away if you think someone else has used your account. You are responsible for activity in your account.
3. Beta status
The Service is in beta: an early version that is still being tested and improved. Features may change, stop working or be removed at any time. We may suspend or discontinue all or part of the Service at any time; where we reasonably can, we will give notice so you can copy your records first. We do not promise to keep any content or data, and you are responsible for keeping your own copies, for example by copying the authorship record and moderation notes the Service builds.
4. No affiliation
LabCauldron is not affiliated with, sponsored by or endorsed by the International Baccalaureate Organization. "IB" and "International Baccalaureate" are trademarks of the International Baccalaureate Organization and are used only to describe the courses the Service supports. Unless a school agrees otherwise in writing, LabCauldron is not operated, sponsored or endorsed by any school, including any school named in connection with the developer.
5. A teaching aid, not a decision-maker
- Marks and results. The Service does not award, predict or guarantee any mark, grade, moderation outcome, IB result, predicted grade or university admission. Teachers, schools and the IB make those decisions.
- Research ideas. Suggested investigations, questions and methods are starting points only. Before any activity begins, the teacher and school are responsible for checking that it is safe, ethical, legal, suitable for the students involved and allowed under school policy and current IB rules.
- Authorship flags. Notebook patterns and flags are prompts for a conversation, never findings of misconduct. Any decision about academic integrity rests solely with the school and the IB.
6. Laboratory and field safety
Laboratory work, fieldwork and work near water, roads or living organisms carry real risk of injury, illness and property damage. All activities must follow your school's risk assessments, supervision rules and safety procedures. We do not supervise, approve or control any activity, and you carry out every activity at your own risk.
7. Your content
"Your content" means anything you enter, upload or create in the Service, such as notebook entries, photos, data, comments and marks. You keep ownership of your content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display your content only as needed to provide, secure and improve the Service.
You confirm that you have every right, permission and consent needed to submit your content, including consent from students, parents or guardians and your school for any information or images of other people. Enter only what the investigation needs. Students should use a first name (and an initial if needed), never a full name, and nobody should enter health details, government ID numbers, contact details or other sensitive information. Photos should show equipment, samples and results, not people's faces. Notebook entries are permanent once saved: they can be deleted with the account, but not edited.
8. Acceptable use
You agree not to:
- break any law, or infringe anyone's privacy, intellectual property or other rights;
- upload confidential IB materials, examination papers or other content you do not have the right to share;
- harass, threaten or impersonate anyone, or misrepresent your connection with any person or organization;
- post anything in a class discussion that is unkind, unsafe or off-topic, or share your research question, data, analysis or report text there before your marks are released;
- use the Service, or any AI feature in it, to produce work that a student submits as their own;
- attach files to a discussion that contain other people's personal information or anything you do not have the right to share;
- upload malware, probe or break security, overload the Service, or scrape, copy or reverse engineer it;
- use the Service to build a competing product, or resell access to it without our written permission.
9. AI features
For IB Biology, Chemistry and Physics reports, teachers can ask the AI examiner, powered by Anthropic's Claude, to suggest marks and quote evidence for a submitted report. Only teachers can run it. AI output can be wrong, incomplete or unsuitable: it is a suggestion, never a mark. Teachers review it and decide every mark themselves. In moderation cases, the AI grades the uploaded student work against the criteria and rubric the teacher provides, only after both teachers have marked it blind; its marks are shown for comparison and the teachers' agreed grade is final. Teachers who upload student work to a moderation case confirm that their school allows them to share it with the colleague they add. The idea engine suggests research ideas and the task builder helps teachers draft tasks and task-specific rubrics; both are starting points that a person must check and adapt. Students must develop their own research question, must not submit AI output as their own work and must declare any AI use as their school and the IB require.
10. Our intellectual property
The Service, including its design, code, text, graphics and the LabCauldron name, belongs to the developer or its licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for its intended educational purpose under these Terms. All other rights are reserved.
11. Third-party services and links
The Service relies on and links to third-party services, such as hosting providers, font services and public databases (for example GBIF, NOAA and the WHO). We do not control them and are not responsible for their content, availability or practices. Your use of them is governed by their own terms.
12. Disclaimer of warranties
The Service is provided "as is" and "as available", with all faults. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, title, non-infringement, and that the Service will be uninterrupted, secure or error-free. No advice or information obtained from the Service creates any warranty.
13. Limitation of liability
To the fullest extent permitted by law, the LabCauldron Parties (defined in section 14) will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, marks, grades, academic standing, admissions, profits, goodwill or reputation, arising out of or relating to the Service, however caused and under any theory of liability, even if advised of the possibility. The LabCauldron Parties' total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim, or fifty US dollars (US$50).
Some places do not allow certain exclusions or limits, so some of the above may not apply to you. In that case our liability is limited to the smallest amount the law allows.
14. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Anum Kazi, Webtronaut Innovations, LLC, and each of their respective affiliates, successors, assigns, officers, directors, employees, contractors, volunteers, agents, hosting and service providers and licensors (together, the "LabCauldron Parties") from and against any and all claims, demands, actions, suits, proceedings, investigations, losses, liabilities, damages, judgments, settlements, fines, penalties, costs and expenses of any kind, known or unknown, including reasonable attorneys' fees, expert fees and court costs, arising out of or relating to:
- your access to or use of the Service, or your inability to use it;
- your content, and any content submitted through your account or by people you allow to use the Service;
- your breach of these Terms or of any law or regulation;
- your violation of any right of another person, including privacy, publicity, data protection, confidentiality and intellectual property rights;
- any investigation, experiment, fieldwork, trip or other activity planned, suggested, recorded or carried out in connection with the Service, including any personal injury, illness, death or property damage;
- any academic decision, including marks, grades, predicted grades, moderation outcomes, examination results, university admissions, and academic integrity or misconduct findings, made by you, your school, the IB or anyone else;
- any student, parent, guardian or other personal information you submit, including any lack of consent, notice or authority to share it;
- any negligent, reckless or wilful act or omission by you or anyone using the Service through you; and
- any dispute between you and any school, student, parent, guardian, teacher, examiner, the International Baccalaureate Organization or other third party.
This obligation does not apply to the extent a court finally determines that a claim resulted from a LabCauldron Party's own fraud, gross negligence or wilful misconduct.
We may take over the exclusive defense and control of any matter you must indemnify, at your expense, and you will cooperate fully with that defense. You will not settle any matter that affects a LabCauldron Party without our prior written consent. If you use the Service for a school or organization, that organization's indemnity applies in addition to your own. This section survives any termination of these Terms or of your use of the Service.
15. Suspension and termination
We may suspend or end your access at any time, for any reason, including a breach of these Terms. You may stop using the Service at any time, and you can delete your account yourself from the Account page in the app. Sections 4 to 7 and 10 to 18 survive termination.
16. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page with a new effective date. If you keep using the Service after a change takes effect, you accept the updated Terms.
17. Governing law and disputes
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Before starting any formal proceeding, you agree to contact us and try to resolve the dispute informally for at least 30 days. Any proceeding must be brought only in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
18. General
- If any part of these Terms is found unenforceable, it will be enforced to the maximum extent allowed and the rest will remain in effect.
- Our failure to enforce any right is not a waiver of it.
- These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
- You may not transfer these Terms without our written consent. We may transfer them, for example to a company formed to run LabCauldron.
19. Contact
Students: please speak to your teacher first; they manage your class and can reset your PIN or remove your account. Teachers, schools and everyone else can email anamanis.k@gmail.com, or reach Webtronaut Innovations, LLC through webtronaut.com.
